Request for Use of NCSA Mosaic Source Code ------------------------------------------ March 2, 1994 The National Center for Supercomputing Applications (NCSA) is making the source code for Macintosh and Microsoft Windows versions of NCSA Mosaic available for research and education purposes on a request basis. To request the source, complete the following steps: A. Print this complete form. Both sections of the form must be completed. B. Complete the information section of the form. C. Read the license agreement section of the form. Sign this section to confirm that you understand and will abide by the agreement. Be certain to indicate which platform you would like by marking the appropriate choice ("Source Code for NCSA Mosaic for the Macintosh" or "for Microsoft Windows"). D. Your original signature must be on file, both sections of this form must be mailed. There will be a $30 processing fee for distribution by diskette, but no charge for electronic distribution of the source. UNIVERSITY OF ILLINOIS NCSA Mosaic SOFTWARE LICENSE AGREEMENT-- Source ----------------------------------------------- Upon execution of this Agreement by the party identified below ("Licensee"), The Board of Trustees of the University of Illinois ("University"), on behalf of NCSA, provides the software ("Software") specified below to Licensee, subject to the following terms and conditions: ____ Source Code for NCSA Mosaic for the Macintosh ____ Source Code for NCSA Mosaic for Microsoft Windows 1. The University grants, and Licensee accepts, a non-exclusive, non-transferable license to use the Software for academic, research and internal business purposes only, without a fee. Licensee agrees to reproduce the copyright notice on all copies. Licensee has no right to transfer the Software to any other person or entity. Licensee may, at its own expense, modify the Software as necessary for the purposes specified herein. 2. THE UNIVERSITY MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THIS SOFTWARE FOR ANY PURPOSE. IT IS PROVIDED "AS IS" WITHOUT EXPRESS OR IMPLIED WARRANTY. THE UNIVERSITY SHALL NOT BE LIABLE FOR ANY DAMAGES SUFFERED BY THE USERS OF THIS SOFTWARE. Licensee understands the Software is a research tool for which no warranties as to capabilities or accuracy are made, and Licensee accepts the Software "as is". Licensee assumes the entire risk as to the results and performance of the Software and/or associated materials. Licensee agrees that University shall not be held liable for any direct, indirect, consequential, or incidental damages with respect to any claim by Licensee or any third party on account of or arising from this Agreement or use of the Software and/or associated materials. 3. Licensee acknowledges that University has a proprietary interest in Software. Licensee acknowledges that source code of the Software is confidential information, and Licensee agrees to maintain the Software in confidence, and further agrees not to disclose the Software to any other person or entity without the prior written consent of University and only on such terms and conditions as University shall prescribe in writing. Licensee further agrees to use reasonable efforts to prevent unauthorized licensing, copying, or use of the Software. If Licensee becomes aware of any unauthorized licensing, copying, or use of Software, Licensee shall promptly notify University in writing. Licensee expressly agrees to use Software only in the manner and for the specific uses authorized in this Agreement. 4. By using or copying this Software, Licensee agrees to abide by the copyright law and all other applicable laws of the U.S. including, but not limited to, export control laws and the terms of this license. The University shall have the right to terminate this license immediately by written notice upon Licensee's breach of, or non-compliance with, any of its terms. Licensee may be held legally responsible for any copyright infringement that is caused or encouraged by its failure to abide by the terms of this license. Upon termination, Licensee agrees to destroy all copies of the Software in its possession and to verify such destruction in writing. 5. In all uses of the Software, where appropriate, Licensee will credit the origins of the Software to the National Center for Supercomputing Applications (NCSA) at the University of Illinois at Urbana-Champaign, for its role in the development of the Software. 6. Should Licensee wish to incorporate a substantial part or all of the Software into a commercial hardware or software product, Licensee will contact the University (jallen@ncsa.uiuc.edu) to negotiate appropriate license for such use. Commercial use includes (1) integration of all or part of the source code into a product for sale or license by or on behalf of Licensee to third parties, or (2) distribution of the binary code or source code to third parties that need it to utilize a commercial product sold or licensed by or on behalf of Licensee. 7. NCSA is interested in receiving information related to the performance of the Software in user's computing environment, and encourages contributions from users of code that might, at the University's sole discretion, be used or incorporated to make the Software a more stable, flexible and/or useful product. Licensees that wish to contribute their code must sign an "Agreement Regarding Contributory Code for NCSA Software" before the University can accept it (contact jallen@ncsa.uiuc.edu for copy).
